EPS 95 Higher Pension Order Search Below:
EPS95 matter impleaded with our petition (118/2018). This message has made some of the members worried.
The fact is that a group of DTC (exempted establishment) employees (35 in number) (Azad Singh & Ors.) had approached the Supreme court through a writ (661/2019) for higher pension similar to us. The court refused to admit it as a fresh petition instead the court gave them liberty to file impleadment Application to implead with main petition i.e. our petition. Accordingly, they have filed IA to implead with our petition, which has been allowed by the court. This is not going to affect our case anyway rather it will give further support to us.
Prior to this, an Intervention petition has been filed by TATA opposing our petition as they claim it will cause a financial burden to them as TATA is exempted under EPS95 scheme and therefore it will be their responsibility to pay higher pension to their employees if the court decision is in favour of our petition. However, till date, TATA's petition has not been allowed by the court and therefore we are not required to take any action on this. Moreover, as per our learned lawyer such prayer has no legal value.
